Thank you for using Apyrun! By accessing or using https://apyrun.io (the "Service"), you agree to be bound by these Terms. If you do not agree, please do not use the Service. We do our best to deserve your trust by being transparent about how we operate.

Important: Apyrun is a business-to-business (B2B) service intended for businesses, professionals, and developers. By using the Service, you confirm that you are acting in a professional or commercial capacity, not as a consumer.

1. Description of Service

Apyrun.io gives your automations superpowers. Full Python, many libraries, no timeouts, one webhook URL. We provide a platform for hosting and executing Python scripts as part of workflow automations.

2. Account & Eligibility

  • You must be at least 18 years of age or the legal age of majority in your jurisdiction to use the Service.
  • You are responsible for maintaining the security of your account credentials.
  • Each person or entity may register only one account.
  • You are responsible for all activities that occur under your account.

3. Ownership & Intellectual Property

Your Content

  • You retain full ownership of all scripts, code, and data you create or upload to the Service.
  • By using the Service, you grant Apyrun a limited, non-exclusive license to host and execute your scripts solely for the purpose of providing the Service to you.

Platform IP

  • Apyrun owns all rights, title, and interest in the platform code, branding, infrastructure, and related intellectual property.

4. Subscriptions & Payments

  • Billing: Subscriptions are billed on a recurring basis via Stripe.
  • No Refunds: All payments are non-refundable.
  • Plan Limits: Each subscription plan has specific CPU, memory, and script quotas.
  • Overages: If you exceed your plan limits, your scripts may be throttled, stopped, or your account may be suspended.

5. Acceptable Use

You agree not to:

  • Use the Service for malware distribution, spam, cryptocurrency mining, or any illegal activities.
  • Abuse platform resources or engage in excessive resource consumption.
  • Circumvent platform security measures, rate limits, or other technical restrictions.
  • Resell or redistribute the Service without our explicit authorization.
  • Use the Service in any manner that violates applicable laws or regulations.

API Credentials

  • You are solely responsible for securing your own third-party API keys and credentials.
  • Apyrun is not liable for unauthorized access to your API credentials.

6. Service Availability

  • Uptime: We will make reasonable efforts to maintain Service availability but do not guarantee any specific uptime or Service Level Agreement (SLA).
  • Maintenance: The Service may be temporarily unavailable for maintenance, with or without prior notice.
  • Suspension: We reserve the right to suspend or terminate access to accounts that violate these Terms.

7. Termination

User Termination

  • You may cancel your account at any time.
  • Access to the Service will continue until the end of your current billing period.

Apyrun Termination

  • We may suspend or terminate your account for violations of these Terms, with or without notice.
  • We may terminate the Service or your access at our discretion.

Data Deletion

  • Upon termination, your scripts, execution logs, and associated data will be deleted promptly.
  • Exception: Billing and invoice records are retained for 10 years as required by German tax and commercial law (§ 147 AO, § 257 HGB).

8. Limitation of Liability

No Warranty

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, to the extent permitted by applicable law.

Liability Cap

Subject to the exceptions below, our total liability to you for any claims arising from or related to the Service is limited to the fees you paid to us in the 12 months preceding the claim.

Exclusions

Subject to the exceptions below, we are not liable for:

  • Loss of data, scripts, or execution logs
  • Third-party API failures or service interruptions
  • Indirect, incidental, consequential, or punitive damages

Mandatory Exceptions (German Law)

The limitations above do not apply to liability for:

  • Intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit)
  • Injury to life, body, or health
  • Breach of essential contractual obligations (Kardinalpflichten) – in this case, liability is limited to foreseeable, typically occurring damages
  • Claims under the German Product Liability Act (Produkthaftungsgesetz)
  • Any other liability that cannot be excluded or limited under mandatory law

9. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Germany.
  • Any disputes shall be resolved exclusively in the courts of Berlin, Germany.

10. Updates to Terms

  • We may update these Terms from time to time.
  • We will notify you of material changes by email.
  • Your continued use of the Service after such notification constitutes acceptance of the updated Terms.
